    Yea, Microsoft's usual knee-jerk reaction.

You are presumed guilty unless you can prove you are innocent!

According to Microsoft: All editions of Windows XP and Windows Vista qualify you to upgrade. So, if you're running either on your PC today, buy a package labeled "Upgrade ".

    http://www.microsoft.com/windows/windows-7/get/upgrade-considerations.aspx

Note that nowhere it says you need a full version. It says any version!

So only the few % of users still running Win9x or Win2000 are not eligible.
